Welcome to Dietlytics! These Terms of Service ("Terms") govern your use of the Dietlytics mobile application ("App", "Service"). By downloading, installing, or using our App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Dietlytics, you confirm that you:

• Are at least 13 years of age
• Have read and understood these Terms
• Agree to be legally bound by these Terms
• Have read our Privacy Policy

If you do not agree to these Terms, please do not use the App.

2. Description of Service

Dietlytics is a nutrition and diet tracking application that provides:

• AI-powered food photo analysis and calorie estimation
• Personalized diet plans based on your goals
• Weight tracking and progress monitoring
• Recipe suggestions tailored to dietary preferences
• Meal logging and nutritional tracking
• Local notifications for reminders

3. User Accounts

3.1 Account Creation

To use certain features, you must create an account using email or Google Sign-In. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Abuse or misuse the Service
• Provide false information

4. Subscription & Payments

4.1 Free Tier

Dietlytics offers a free tier with limited features and advertisements. Free users have access to basic food logging and tracking features with daily scan limits.

4.2 Premium Subscription

Premium features include:

• Unlimited food scans
• Ad-free experience
• Advanced analytics and insights
• Priority AI processing
• Exclusive recipes and features

4.3 Billing

• Subscriptions are billed through Google Play Store
• Subscriptions auto-renew unless cancelled 24 hours before the renewal date
• Refunds are handled according to Google Play's refund policy
• You can manage subscriptions in your Google Play account settings

5. User Content

5.1 Your Content

You retain ownership of content you submit (photos, logs, data). By using the Service, you grant us a license to:

• Process and analyze your food photos using AI
• Store your data securely on our servers
• Use anonymized, aggregated data to improve our services

5.2 Prohibited Content

You agree not to upload or share content that is:

• Illegal, harmful, or offensive
• Infringing on intellectual property rights
• Malicious software or code
• Spam or misleading information

6. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems
• Use automated scripts or bots to access the Service
• Interfere with or disrupt the Service
• Share your account with others
• Use the Service for commercial purposes without permission

8. Intellectual Property

All rights, title, and interest in the App, including but not limited to:

• Software code and architecture
• User interface design
• Logos, trademarks, and branding
• AI models and algorithms
• Recipe content and images

are owned by Dietlytics and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without permission.

The App integrates with third-party services including:

• Google Firebase (authentication & storage)
• Google Gemini AI (food analysis)
• Google AdMob (advertisements)

Your use of these services is subject to their respective terms and policies.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIETLYTICS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Health-related issues arising from use of the App
• Actions taken based on App recommendations

Our total liability shall not exceed the amount you paid us in the past 12 months, or $50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Dietlytics, its affiliates, and employees from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Effective Date" at the top
• Sending a notification for significant changes

Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of India.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
